Liability Waiver Statement

1. I/WE UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH WATER SKIING, WAKE BOARD AND TUBE ACTIVITIES, including but not limited to equipment failure, perils of the lagoon, harm caused by marine creatures (including bites), acts of fellow participants, entering and exiting the water and I/WE HEREBY ASSUME SUCH RISKS.
2. I/WE UNDERSTAND THAT I/WE HAVE THE DUTY TO EXERCISE RESONABLE CARE FOR MY/OUR OWN SAFETY AND AGREE TO DO SO.
3. I/we assert that I/we are physically fit to participate in the booked water Sport activities and will not hold the Released Parties responsible if I/we are injured as a result of ANY problems (medical, accidental or otherwise) which occur while participating in the trip.
4. I/we will not remove any flotation device at any time while participating in the water sport activities. I/we acknowledge that doing so will constitute a violation of safety rules and procedures for which I/we expressly assume the risk 5. If I/we become distressed, I/we will immediately notify the Skipper
5. I/we fully understand that the involved operation has limited medical facilities and that in the event of illness or injury appropriate medical care must be summoned by radio or mobile phone and treatment will be delayed until I/we can be transported to a proper medical facility. I/we agree in advance of these conditions.
6. The Released Parties have made no representation to me/us, implied or otherwise that they or their staff can or will perform safe rescues or render first aid. In the event I/we show signs of distress or call for aid, I/we would like assistance and will not hold the Released Parties, their staff, boat or other participants responsible for their actions in attempting the performance or rescue or first aid.
7. IT IS MY/OUR INTENTION BY THIS STATEMENT FORM TO GIVE UP MY RIGHT TO SUE ALL PERSONS OR ENTITIES REFERRED TO HEREIN, WHETHER SPECIFICALLY NAMED OR NOT, AND ITS IS ALSO MY/OUR INTENTION TO EXEMPT AND RELEASE ALL RELEASED PARTIES AND TO HOLD THESE ENTITIES HARMLESS FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE or WRONGFUL DEATH CAUSED BY NEGLIGENCE OR GROSS NEGLIGENCE AND I/WE ASSUME ALL RISK IN CONNECTION WITH THE WATER SPORT ACTIVITIES, INCLUDING BUT NOT LIMITED TO THE MAINTENANCE OF THE EQUIPMENT OR ORGANISATION OF THESE ACTIVITIES.
8. I/we have carefully read this statement/form in its entirety, fully understand its contents, and agree to the terms and conditions of this statement/form on behalf myself/ourselves. This statement/form constitutes the final and entire agreement between Released Parties and the undersigned. There are NO WARRANTIES expressed or implied, which extend beyond the description of the activity listed in this statement/form or Water Sport Activity booked. THIS IS A COMPLETE RELEASE OF LIABILITY AND A LEAGALLY BINDING STATEMENT/FORM/CONTRACT.

I/WE have read this agreement, are aware that it is a release of liability and a contract between myself/ourselves and the Released Parties. I/WE sign it of our own free will and agree to be bound by it , from the date of my/our signature, forever in the future.
