1. Definitions

For the purpose of these Terms and Conditions:

    • “Company” means The Lagoon Mavericks …….
    • “Client” means the person making the booking and entering into this contract with the Company
    • “Guests” means all persons attending the charter at the invitation of the Client.
    • “Vessel” means the ………………… operated by the Company.
    • “Crew” means the skipper and host employed by the Company.
    • “Charter” means the services supplied by the Company on the agreed date and time. By making a booking, the client confirms that they have the authority to accept these terms on behalf of all guests that make up the clients booking.

2. Booking and Contract formation

2.1 A booking is confirmed once the Company has received confirmation via its website booking portal that booking has been paid.

2.2 Until the booking payment has been received, the Company reserves the right to offer the requested date and time to other parties.

2.3 We depart exactly to schedule – ensure you arrive 15 minutes before scheduled departure so we can properly complete a Safety briefing and safely board everyone. Any late arrivals will miss their scheduled departure and will lose the booking with no refund.

3. Pricing and Payment

3.1 All prices are inclusive of VAT unless stated otherwise.

3.2 The total charter price is required at the time of booking to secure the Charter.

3.3 Any additional charges or extras agreed during the Charter are payable on the day by card, bank transfer, or other approved payment method.

4. Cancellation by the Client

4.1 If the Client cancels the Charter:

4.1.2 2 (two) working days, up to 4 (four) working days: 50% of the Charter price will be refunded, minus any banking/credit card charges.
4.1.3 1 (one) full working day prior to booked charter: 25% of the Charter will be refunded, minus any banking/credit card charges.
4.1.4 Less than 1 (one) full day prior to booked charter: No refund will be provided.

4.2 No refunds are available for non-attendance or late arrival.

5. Weather, Tides & Itinerary

5.1 Charter itineraries, departure times, and duration are not guaranteed and may be varied at the discretion of the skipper due to weather, tide, traffic, or safety considerations.

5.2 The skipper’s decision regarding safety and operation of the Vessel is final.

6. Refreshments & Alcohol

6.1 Refreshments and Alcohol may be served responsibly, and the skipper may refuse or limit where safety, weather, or conduct requires

7. Cancellation or Modification by Company

7.1 The Company reserves the right to cancel or modify the Charter due to circumstances beyond its control, including but not limited to:

    • Adverse weather or Lagoon conditions
    • Mechanical failure
    • Safety concerns
    • Force majeure events (including war, civil unrest, or public health emergencies)

7.2 Where the Charter is cancelled by the Company before departure, the Client will receive a full refund of monies paid or, where agreed, the option to reschedule.

7.3 Where the Charter proceeds but is modified, delayed, or curtailed for safety or operational reasons, no refund shall be due, This includes circumstances where weather conditions are safe to operate but unsuitable for the Client’s expectations.

8. Guests & Capacity

8.1 The Charter price applies to the exclusive use of the Vessel for up to:

    • 10 Guests for standard Cruises, swimming and snorkelling
    • 8 Guests for Water Sports – Tube
    • 6 Guests for Water Sports – Skiing and Wake Board.

8.2 No reduction in price is available for fewer Guests attending based on original Client booking

9. Conduct, Safety & Authority

9.1 All Clients and Guests must comply with instructions given by the skipper or Crew at all times.

9.2 The Company expects a standard of behaviour that is socially and legally acceptable. Any Guest behaving in a dangerous, abusive, or discriminatory manner may be required to disembark without refund.

9.3 Guests who are unable to swim may be required to wear a lifejacket while onboard.

10. Liability & Insurance

10.1 The Company maintains appropriate insurance cover for its operations. Details are available on request.

10.2 The Company accepts no liability for loss of or damage to personal property brought onboard, unless caused by proven negligence of the Company or its Crew.

10.3 The Client is responsible for any damage to the Vessel or equipment caused by the negligent or wilful acts of the Client or Guests.

11. Indemnity, Liability & Liability Waiver Statement

11.1 The Client agrees to indemnify and hold harmless the Company, its directors, employees, and agents against all claims, losses, or expenses arising from the actions of the Client or Guests,
except were caused by the Company’s negligence.

11.2 All guests agree to sign a “liability waiver statement” when booking any Water Sport such as Water Skiing, Wake Board and Tube charters, with the Company

12. Acceptance

By completing a booking and making payment, the Client confirms acceptance of these Terms and Conditions on behalf of themselves and all Guests.
